What is an Installment Agreement? An Installment Agreement is a workable payment plan between you and the Franchise Tax Board. The California Franchise Tax Board wants you to pay your back tax debt in full and without delay if you have the financial ability to do so. Before granting an Installment Agreement, the Franchise Tax Board will even encourage you to borrow from a private source to pay your tax liability in full. Given the current economic situation and the effects of the recession on the state economy, the California Franchise Tax Board is tightening the screws on the payment of back taxes. The Tax Compliance Officers are less likely to compromise unless you have the experience of trusted Tax Experts on your team.

We know how to work with the State Tax Compliance Officers to develop an Installment Agreement that works for you. If you do not have the financial resources to cover your tax debt, you may be eligible for an Installment Agreement. Although the FTB want you to make the largest monthly payment possible, we have the experience and the expertise to negotiate an Installment Agreement for you. Due to the strict nature of the California Franchise Tax Board, interest and some penalties can continue to accrue until your tax debt is paid in full.

You may qualify for an installment agreement with the California Franchise Tax Board, if your state tax debt is $25,000 or less, you agree to pay your tax bill in 60 months or less, and you have filed all required personal income tax returns. The Tax Experts at the Tax Resolution Institute will make sure that all of your past and present tax returns are filed properly before we begin negotiations.

Once negotiations have begun, we have the ability to achieve the best terms for you of an Installment Agreement with the California Franchise Tax Board. Since we are based in Southern California, we have experience with the Franchise Tax Board and we have successfully worked with them in the past on countless other tax cases.

After we successfully negotiate your Installment Agreement, the Franchise Tax Board will require you to agree to the following conditions: 1) You presently have a financial hardship and cannot pay your back taxes, 2) You will file and pay all future tax returns in a timely manner, and 3) You have to pay a $20 fee for establishing your Installment Agreement. That’s it. Once you agree to these simple requirements, all collection actions by the California Franchise Tax Board will cease.

If the California Franchise Tax Board denies our proposed Installment Agreement and we disagree, we can file a request for a review. By sending a written request within 30 days from the date of the denial notice, we are given the ability to prepare a proper appeal. In addition, we provide ourselves with the time to look for other possible solutions to your tax problems.

If the California Franchise Tax Board cancels your Installment Agreement on account of a perceived violation of the requirements, the same process as above takes place. By sending a written request to the Revenue Officers, we provide the necessary breathing room to prepare a defense and appeal the decision to cancel.
